Michigan Lawsuit Demands Public Release of Voter Registration List

On October 24, a group of Michigan journalists and political consultants filed a lawsuit in state court, asking that the Michigan presidential primary law be declared unconstitutional. The law provides that any voter can vote in either major party’s presidential primary (Michigan does not have registration by party). However, in order to vote in a presidential primary, a voter must identify himself or herself. These lists of which voters voted in each party’s presidential primary are then given to the political parties, but no one else may see them. The lawsuit argues that if the information is being given to the parties, it must be available to the public. The lawsuit is in Ingham County Circuit Court and is probably called Grebner v Land.   1. Case is Grebner v. State of Michigan.

    The State of Michigan will likely be dropped and have the Secretary of State as the chief defendant. See the Michigan Court Rules about suing public officers – by title of the office involved.

    Michigan Constitution –

    Art. II, Sec. 4. The legislature shall enact laws to regulate the time, place and manner of all nominations and elections, except as otherwise provided in this constitution or in the constitution and laws of the United States. The legislature shall enact laws to preserve the purity of elections, to preserve the secrecy of the ballot, to guard against abuses of the elective franchise, and to provide for a system of voter registration and absentee voting. No law shall be enacted which permits a candidate in any partisan primary or partisan election to have a ballot designation except when required for identification of candidates for the same office who have the same or similar surnames.

  2. Case is being argued right now -as “Grebner v. State of Michigan”. The appellate hearing is ensuing now, live on MGTV, before the appeals court. Heather Meingast is the attorney for the State of Michigan.
