Kucinich Barred from Texas Democratic Primary Ballot; Sues Party Over Oath

On January 2, Dennis Kucinich sued the Texas Democratic Party for refusing to list him on the presidential primary ballot. The case is Dennis Kucinich v Texas Democratic Party, A08-ca-7LY. The case was assigned to Judge Lee Yeakel, a Bush Jr. appointee. UPDATE: this case will be argued on January 11.

Ballot access to the Texas Democratic Party requires a fee of $2,500 and signing an oath that the candidate will “fully support the Democratic nominee for President, whoever that will be.” Kucinich had originally signed the oath, but he had scratched out the last part. He said he would support the eventual nominee if that nominee were opposed to U.S. policy on Iraq. The party waited 5 days and then rejected the oath as amended by Kucinich. This case will probably have an outcome in the next week or ten days.

  1. It is totally unconstitutional to force someone to sign an oath to support a nominee. Every American has the right to support the person he chooses. This act of denying him a spot on the ballot is contrived and illegal. Do the right thing and allow Dennis Kucinich to be on your grand states ballot! Anything less than this will reflect poorly on the Democratic Party and the State of Texas.

  3. This is another sad day for the Democratic party. It is not only unconstitutional but cowardly. If you haven’t the faith that your chosen candidate will best represent the people and have to create an illusion of support then you represent no one. Look up the definition of democratic please.

    Shame on you for excluding Dennis Kucinich from the state ballotI Is this a Fascist Nation we live in? This sounds like a tactic that the Republican paty would use, but you only go to show that there is simply no difference between the two parties. Shame!

    The citizens of this country adamently DEMAND that you reinstate Congressman Kucinich on the ballot! This is unconstitutional and simply and plainly unfair.

  5. I believe that not allowing Dennis Kucinich to participate in the debate is an unconstitutional act. I believe by doing so you are undermining the democratic process which this country was built upon.

    Dennis represents the voice that a majority of U.S. citizens are demanding at this time in our country.

    Who pays you to exclude Dennis Kucinich? Have you even listened to what he has to say? If so why are you not connecting with his message? Who has bought you out?

    We passed Resolutions stating we were against the war–how about that? So when a candidate states he upholds our platform–which we all passed–he’s off the ballot?!

  7. Please resolve this quickly. We need to start preparing the ballots. Both electronic and paper ballots must be prepared. As of Jan 4th 2008 applications for ballot by mail began arriving. Many of these are from soldiers and sailors serving abroad. These ballots need to be finalized, prepared and mailed so the voters most impacted by who is commander and chief of the armed forces have the opportunity to vote. The Texas Democratic party is being foolish. To require one person to support another not knowing who that would be is foolharding. Please remember not all those nominated by primary deserve support. As such accept Dennis on the ballot and lets move on.

  8. We want Dennis Kucinich on the Texas Primary Ballot! Why must someone sign an oath to support another candidate in the Democratic Party? They don’t make Republicans sign an oath like that. Do you think Ron Paul would endorse any of the candidates he is running against? NO! Mr Kucinich and his message deserve to be heard! We want Kucinich and Strength Through Peace! He is the only TRUE Democrat running in the race!

    Ask yourself (ASK THEM) what has changed since the Midterm elections of 2006? NOTHING!! Their approval rating is even lower than Bush/Cheney!

    PUT HIM ON THE BALLOT — and do it voluntarily, rather than because of a COURT ORDER! YOU ARE SIMPLY SHOWING US WHAT FOOLS AND TYRANTS YOU ARE!!!
