U.S. Supreme Court Conference of January 9

The U.S. Supreme Court holds a conference on January 9. The Court will consider whether to hear Northwest Austin Municipal Utility District Number One v Mukasey, no. 08-322. Usually the case is referred to as the acronym “NAMUDNO v Mukasey.” This New York Times op-ed explains the drama behind this case. Unlike most cases, the Court can’t simply refuse to take a position. It must either affirm the lower court ruling, or set the case for a full hearing in the U.S. Supreme Court itself.

Also on the January 9 conference is one of the many cases involving President-Elect Barack Obama’s qualifications. Similar cases are on two more conferences later this month.

The Court generally doesn’t say what it decided on the day it holds a conference. Most information about the conference is not released until the following workday. In this case, the following workday is Monday, January 12.

  3. wait to Monday — the best I would hope for would be the court formally requesting Obama’s team to respond with documentation before next Friday’s conference.

  4. Richard- I’d be interested in your thoughts. It seems these cases, particularly Keyes, are moot, regardless of merit. You can’t remove someone from the ballot in an election that has already been held, nor withhold Electoral College votes that have already been cast and accepted by Congress. Thus, the remedies demanded by plaintiffs are impossible to satisfy. As for removal from office, I simply don’t see that as within the purview of the judicial branch. Only Congress, through impeachment, can remove a Pres. Judges can’t fire the Pres and the Pres can’t fire judges.

    On a more general note, there sems to be a tendency by many here and elsewhere to ascribe God-like powers to judges to fix every ill. As an illustration, I give you the case in NY of the man who gave his wife a kidney and now that they are divorcing, wants it back.

  5. (To the best of my knowledge & understanding) If Obama is deemed ineligible, Biden would be sworn in as President and could then nominate someone as VP who would need Congressional approval; which shouldn’t be a problem with the Dem majority.

  7. If his election were validated by Congress then they would have to remove him by impeachment. They are the ONLY ones with the power to remove a President. You show me where the Constitution gives anyone else that power.
