West Virginia Attorney General Says Special Election for U.S. Senate OK for November 2010

On July 8, the West Virginia Attorney General ruled that the state is free to hold a special election for U.S. Senate on November 2, 2010, even if the legislature does nothing.  The Attorney General said that the Governor is free to proclaim a special primary election date.  See this story.

  1. Soooo– the WV laws are perfectly clear about ballot access in any such special primary election ??? — or more standard chaos due to negligent party hacks in the WV legislature since 1914 ???

  2. Richard, in this special election in West Virginia, what must 3rd parties and independents do to get on the general election ballot? Does the “lack of such legislation” open any doors for ballot access reform via the Courts?

  3. So here we go with the Democrats making the election law mean whatever they want it to mean. At first, based on the number of days left in Byrd’s term, it meant that the special election should be this year, but the ‘Rats in charge of the legislature, and thus the election law, had made no provisions for a primary. Then, ‘Rat Sec of State Natalie Tenant said that she interpreted the law to mean that the election should be Nov 2012 which got everyone upset. Stir up public sentiment for an election this year and in comes “Hello Joe” Manchin to the rescue to get what he’s wanted all along. CLASSIC!

    Bottom line is that the ‘Rats have known that Byrd was going to pass away in office ever since Manchin got elected six years ago. IT IS COMPLETE AND UTTER IRRESPONSIBILITY for them, being totally in control of ALL BRANCHES of our government, to have not already had this figured out and the election law nailed down! THIS IS SO OBVIOUS ANS DELIBERATE MALFEASENCE for political gain!
