Montana Bill to Require Candidates for Federal Office to Submit Birth Certificate

Montana State Representative Bob Wagner (R-Madison County) has introduced HB 205. It requires candidates for President and Congress to submit a birth certificate or other proof of birth, when they file paperwork to appear on either a primary ballot, or a general election ballot, or even to file as a declared write-in candidate. The only loophole in the bill, for presidential candidates, is that someone who didn’t run in a presidential primary in Montana, but who is nominated by a ballot-qualified party, need not file the documents to appear on the ballot in November.

Members of Congress need not have been born in the United States, so the ostensible purpose of applying this bill to congressional candidates is to satisfy the U.S. Constitution’s requirements as to age. Members of the U.S. House must be 25; U.S. Senators must be 30. Thanks to Bill Van Allen for this news.

Every time the paperwork connected with filing for office is made more complicated, chances increase that something will go wrong, and otherwise qualified candidates will be disqualified for inadvertent errors.

  1. So this bill only applies to candidates running in a primary? You are right the more paperwork the more things can go wrong.

  2. It also applies to independent candidates and write-in candidates. But it would not apply to, for example, the Libertarian Party presidential nominee in November 2012, because the Libertarian Party never participates in a presidential primary in Montana, yet the party is ballot-qualified.

  3. As usual the place of birth means about ZERO.

    It is the nation state status of the father of the kid.

    See *subject to the jurisdiction thereof* in 14th Amdt, Sec. 1.

    FOREIGN fathers having their kids physically born in the U.S.A. are NOT subject to the jurisdiction of the U.S.A. regime — diplomats, military, students, tourists, green card workers, ILLEGAL invaders (aka illegal immigrants), ship wrecked, etc.

    NATION-STATE allegiance means something — regardless of the New Age one world MORONS.

    Way too difficult for constitutional law MORONS to understand — especially the party hack SCOTUS super MORONS for the last 140 plus years.

  4. If two or more LP presidential candidates filed in Montana then the state would have to print ballots for the primary.

  5. It looks to me that the Hon. Representive Bob Wagner is a “moron” or in Cody lingo the color “mooron”. It states that citizenship is covered by the 17th Amendendment (sic.) it excludes people running for President from the District of Columbia (Sorry, Al Gore).

    P.S. The good parts of the bill would keep persons like
    Obama (born on Mombasa Island and a Subject to the Sultan of Zanzabar) or McCain (born on Colon Island,
    Republic of Panama out of wedlock) off the 2012 ballot
    if they choice to run again in 2012.

  6. Every Governor, Representative or Senator that is
    a really honest person should do the same thing in
    his/her district as Rep. Bob Wagner of Montana.

    We all know now that there is an ‘element’ in
    the present administration that has done great
    harm to our Constitution (even though they SWORE
    ALLEGIANCE TO PROTECT THAT CONSTITUTION )

    Until we can once again call this a free and
    honest country we ask those in control of their
    states and districts to help us make our country
    honorable again.
