Response Brief Filed in Alabama Ballot Access Case

On April 9, the Alabama Constitution, Green, and Libertarian Parties filed this 9-page response brief in Stein v Chapman, 2:12cv-42. This is the case that challenges the March petition deadline for minor parties, at least as applied to presidential elections.

  1. This is a clean argument regarding early filing deadlines. In the Oklahoma case, the state made the argument that its series of primaries and run-off primaries for new as well as established parties, in conjunction with a law passed by Congress for overseas soldiers, necessitated the early deadline. In this case, there apparently is no complication of primaries for lower offices. Perhaps the only party candidate qualified for office is the presidential candidate. Or perhaps new or small parties nominate candidates for lower office by convention.

  2. I realize this article is about the most important law suit, but is a good place to remind all one last time to email a generic letter to each Alabama Senator – asking him or her to vote for SB 15.
