U.S. District Court Refuses to Reconsider Decision in Nader v Federal Election Commission

On April 12, U.S. District Court Judge Royce Lamberth issued this 12-page order in Nader v Federal Election Commission, 1:10cv989. Nader had filed the case in 2010, arguing that the FEC was wrong to have dismissed his complaint against the Democratic Party for spending millions of dollars in 2004 to keep him off the ballot, and then failing to report these expenditures. Nader couldn’t file the case earlier than 2010 because it took the FEC so long to dismiss Nader’s complaint.

On November 9, 2011, Judge Lamberth had dismissed Nader’s lawsuit against the FEC. On December 9, Nader had asked him to reconsider. Judge Lamberth won’t reconsider, but it is noteworthy that he wrote such a lengthy explanation defending his original decision. Nader will appeal to the U.S. Court of Appeals.

  1. Honorable MP Ralph Nader [Independent] was nominated to the First Internet Presidential Preference Vote Election of 1994 and agreed to remain on the ballot, along with 124 others, from 25 different parties and categories.

    Soon after, he was also asked to run on the Green Party of California’s ticket, and the news was released on Ballot Access News.

    However, MP Ralph Nader [Independent] never bothered to contact the parliament again, and after several consecutive presidential election campaigns under various parties/categories, his team never caught traction.

    And here is law suit has failed, in his attempt to sue, he is not victorious.

    I hope that this is a lesson for everyone. We may never know if it might be better to work together as a team.

    But suing yourself to victory didn’t seem to work.

  2. What candidate or party has the current record for the number of court cases regarding ballot access ???

    Only the BAN archives/database knows for sure ???

  3. #2, Eugene McCarthy still holds the record for candidates, for his 1976 lawsuits against the 12 states that at the time didn’t have procedures for independent presidential candidates to get on the ballot. Plus he had other ballot access lawsuits the same year on different subjects.

    But the party that has filed the most is the Libertarian Party. The LP has sued Alabama, Alaska, Arizona, California, Colorado, Connecticut, Delaware, DC, Florida, Georgia, Hawaii, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, South Dakota, Tennessee, Texas, Vermont, Virginia, Washington, West Virginia and Wyoming.

  4. These are all states where the Libertarian Party is not trying, and has never tried, to work with other parties as a team based on votes cast under pure proportional representation, Hagenbach-Bischoff method, and they’re not for that;

    Alabama, Alaska, Arizona, California, Colorado, Connecticut, Delaware, DC, Florida, Georgia, Hawaii, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, South Dakota, Tennessee, Texas, Vermont, Virginia, Washington, West Virginia and Wyoming.

  5. The New Libertarian Party candidate, James Ogle [Free Parliamentary], will be kicking off a nation-wide election which will elect a 1000-member national team under pure proportional representation (PR).

    — due to the nonstop arbitrary irrational UN-equal JUNK SCOTUS ballot access opinions since 1968

    — how many — circa 20-30 (???) at least ???

    What century before 5 of 9 SCOTUS folks detect the *equal* in 14th Amdt, Sec. 1 — regarding ballot access ???
