Hearing Set for Injunctive Relief in Justice Party Lawsuit over Vermont Petition Procedures

On July 31, at 9 a.m., a Vermont Superior Court in Montpelier will hear Anderson v State of Vermont, 480-6-12. This is the case filed by the Justice Party over Vermont’s awkward procedures for submitting petitions for independent and minor party candidates. For those kind of petitions, Vermont requires the petitioning groups to turn in signatures to each town clerk, then collect the signatures and physically take them to the Secretary of State’s office. Sometimes the town clerks don’t check the petitions very quickly. Rocky Anderson submitted the needed 1,000 valid signatures by the deadline but he is still not on the ballot because the town clerks took too long to check the signatures.

By contrast, primary candidates running for statewide office can submit their petitions directly to the Secretary of State. Federal law requires all state election offices to maintain a statewide list of the registered voters.

  1. Day after day, year after year, we see those who choose lawsuits as a path to victory. Yet those same people continually spurn the idea of teamwork psychology based on ranked choice ballots cast and kept as proof, the Sainte-Lague parliament seat distribution system, Hagnebach-Bischoff method, the USA Parliament.

  2. Reminder — Having elections is one of the very few things that State/local govts MUST do.

    IF the courts have ANY brain cells, then they will NOT be amused by the NON-action in checking the signatures.

  7. #8, I think the prospects are good. Only the Justice Party is in this lawsuit. The Green Party didn’t actually get 1,000 valid signatures before the deadline.

  10. #7 People in Lichtenstein seem to enjoy monarchy and it benefits them quite heavily given that the citizens they have the second highest per capita income in the world (more than 2.5 times the USA’s), super low crime rates, and super high standards of living. They like monarchy so much that a few years ago they actually voted to amend their constitution to give the prince even more powers than he already had. In fact the top five per capita income countries in the world are Monarchies (Monaco, Lichtenstein, Luxembourg, Norway, and Qatar) and of those 3 have monarchs that regularly exercise their executive power (Monaco, Lichtenstein, and Qatar).

    I’m certain that everybody needs a wake-up call every once in to show their disdain of teamwork and unity through elections with votes cast as proof as an alternative to violence and civil war.

    Coincidentally, at the moment I’m attending a NAACP meeting in a library, and I must remind everyone of her rejection as a “quota Queen” by the establishment in 1992 regarding her appointment as Attorney General, and the ways things could be different from items like Waco to electoral reform.

    Certainly “Casual Bystander” will have some wisdom as to a better alternative to pure proportional representation for the more serious readers?

  12. #8, the Green Party’s better chances would be if the Vermont Supreme Court hears the Trudell case against the June petition deadline quickly. But so far they are planning to hold the hearing in September, which means that even if it wins it won’t help anyone this year.

And of those four Napoleon was actually elected to become emperor in a free democratic election, and George the III was actually a rather good king by the standards of the day. I would much rather have lived under the constitutional monarchy and low taxes of George the III than the democracy and high taxes the United States has today.
