U.S. District Court Issues Injunction, Putting Tennessee Libertarian Party on Ballot for Special Legislative Election

On October 31, U.S. District Court Judge William Haynes put the Tennessee Libertarian Party nominee for state legislature in Memphis on the ballot with the label “Libertarian”. If the injunction had not been issued, then the candidate, James Tomasik, would have been on the ballot as an independent instead. The case is Tomasik v Goins, 3:13cv-1118. The election is being held on November 21, to fill the vacant State House seat, 91st district. More details later.

  1. It was a very good hearing. Jim Linger, representing LPTN and Jim Tomasik, did a very good job. The State did not put up much of a fight. This is a good day for alternative parties in Tennessee.

    Any ballots going to and from Asia where the troopers are fighting the BARBARIANS ???

    Have candidate/member rank order lists for filling legislative body vacancies.

    I.E. NO more moron very costly special elections.

  3. In court today, a witness for the local election commission said not a single overseas absentee voter had requested a ballot in this election.

    Under 10 ??? — who likely have NO idea that there is a very costly special election being held.

    Cost per vote – to have a mini-army of poll workers waiting for ANY voters to show up on special election day ???

  5. The winner of the Democratic primary received fewer than 1,000 votes in that primary. There is no Republican running; only two candidates will be on the November 21 ballot.

  6. But Tennessee is in the same Circuit as Tennessee (the 6th). A previous case from Tennessee with the Green Party and the Constitution Party is on appeal in the 6th Circuit. That is why the state did not say much, they did not want to do anything to mess up their appeal,which in my opinion is already a mess.
