    The Florida Constitution provides that a legislator takes office upon election; it also provides that special elections to fill vacancies provided by statute.

    100.111(5) In the event of unforeseeable circumstances not contemplated in these general election laws concerning the calling and holding of special primary elections and special elections resulting from court order or other unpredictable circumstances, the Department of State shall have the authority to provide for the conduct of orderly elections.

    I think that that this situation qualifies.
