Kansas and Arizona Request Rehearing in Tenth Circuit in Lawsuit Over Federal Voter Registration Forms

On December 22, the last possible day, the states of Kansas and Arizona asked the Tenth Circuit for a rehearing in Kobach v U.S. Election Assistance Commission, 14-3062. This is the case concerning the federal voter registration form. The Tenth Circuit had ruled 3-0 on November 7, 2014, that the states cannot force the federal government to amend the federal forms that are used in those two states, to require applicants to attach proof of citizenship other than just a signature over penalty of perjury. Kansas and Arizona are only asking the three original judges to reconsider; they are not asking for a rehearing en banc. This post has been amended; it originally said the states were asking for an en banc rehearing.

  1. I have not problem with a proof of citizenship being required for one to be able to register to vote.

    I know there is an element out there that wants to see the illegals continue to pour over the border, grow up and when old enough register as Democrats.

    This could prove a disaster for the partisan electoral system we have in the country, and the hope that one day not only our legislatures, but Congress will be represented by more than two parties.

    Yes, proof you are a citizen, then you can register to vote.

  2. The federal form is a postcard. It is ridiculous to force people to attach copies of naturalization papers to a postcard.

    We don’t require someone to show his or her drivers license every time the person steps into a the drivers seat of a car.

    Stores no longer require a signature when the purchaser uses a credit card and the amount is fairly small. Sometimes it just makes sense to stop being afraid. Because of Kansas’ policy on voter registration forms, there are tens of thousands of unprocessed voter registration forms sitting around in limbo, and all the people that filled out those forms weren’t able to vote in last months’ election.

    I know an illegal alien family and voting is the last thing they would do. They just try to survive economically and keep out of any trouble with any government authorities.

    The U.S. Election Assistance Commission held weeks of hearings and gathered tens of thousands of pages of evidence, and the Commission found that there is no evidence that aliens use these forms to register to vote, except in the most miniscule numbers.
